26. So for as the judgment relied by the learned
counsel for accused reported in AIR 2019 Supreme
Court 1983 between Basalingappa Vs. Mudibasappa is
concerned, in the said case, the accused has
questioned the financial capacity of the complainant to
lend the cheque amount to the accused. In the said
case, the complainant has failed to prove his financial
capacity. Under such circumstances, the accused was
acquitted interalia that the complainant has failed to
prove his financial capacity.
