Therefore, without making any comment on the impugned judgment and award of learned tribunal on its merit it is simply indicated that this court is unable to act as an appellate court in exercise of its supervisory power under Article 227. The writ petition under Article 227 of the Constitution of India is not maintainable against the impugned judgment and award dated 14.8.2006 passed by the learned Tribunal, Nothing has been held by the Supreme Court in L. Chandra Kumar (supra) which goes contrary to the decision of Sadhana Lodh (supra) as the later one is a verdict which is directly on the point in issue in reference to Motor Vehicles Act and the said judgment of Sadhana Lodh (supra) has not yet been diluted or overruled in any subsequent decision of Hon'ble Supreme Court.
