Saij Gram Panchayat vs State Of Gujarat And Ors on 27 January, 1999

In Saij Gram Panchayat v. State of Gujarat (supra). It is clear from the text of paragraph 13 of the said judgment that by notification dated 14-4-1994 issued by the Gujarat Government in exercise of powers conferred by Clause (2) of Article 243Q of the Constitution, Gujarat Government had specified certain areas comprised in the gram or nagar and had declared them to be the transitional areas. Under Sub-clause (2) of Article 243Q of the Constitution, Governor has to issue public notification considering the population of the area, density of the population therein with other factors mentioned in the said Article 243Q(2) of the Constitution. No such notification has been issued by the governor of the State; at any rate no material in this behalf is produced before us. Under these circumstances, the submissions made in this behalf are devoid of any substance. The same cannot be accepted. In the result, the challenges set up by the petitioners must fail.
