23. In order to prove the charges for the offence U/s 304-A IPC, the
prosecution has to prove that the rash and negligent act of the accused was
the proximate cause of death of deceased. The prosecution has to further
prove that the negligence and rashness on the part of the accused was of
such a degree so as to endanger the human life and safety. Rashness
convey idea of doing reckless act without considering any of its
consequences whereas, negligence connotes want of proper care. Reliance
