order of Hon'ble ITAT Patna Bench for AY 2002-03 wherein the appellant's
appeal on allowability of penal interest was allowed by the Bench by citing
judgment of Apex Court in the case of Mahalakshmi Sugar Mills Co. Vs. CIT
(123 ITR 129).
