Perusal of para 344(b) of Pension Regulations of the Pension
Regulations reveals that 'age of the official shall be taken as being the age
he will attain on the next birthday following the date on which the
commutation shall become absolute, subject to such addition of years of age
in the case of impaired life, as may be recommended by the medical board'
and the same does not seem to be illegal or unreasonable and has further
stood the test of time. No basis has been laid down in the petition to show
that the same is liable to be set aside as being arbitrary. Therefore, the
prayer for setting aside the para 344(b) is also without any merit and hence,
rejected.
