9. Full Bench of this Court in Jabir Hussain Nasir Ahmed
Boga v. State of Gujarat reported in 2006 (1) GLR 10 held that
process of election is deemed to have commenced from the date on
which order of delimitation of Wards is made by the State Election
Commission and further held that the bar imposed by Art.243-ZG is
absolute and that the resolution of any dispute pertaining to an
election which has the effect of interrupting, obstructing or
protracting the election shall be postponed until after the completion
of the election.

Counsel for the petitioner relied on a decision of learned single Judge
in case of Gohel Sunil Devshi v. State Election Commission reported
in 2001 (1) GLR 163. The dispute involved in the said petition was
relating to validity of the mandate by the sponsoring party in favour
of a candidate. We may notice that in such decision having held that
a writ petition would be maintainable, nevertheless the petitioner was
relegated to the remedy of filing election petition.
