Mr.Pandya has placed reliance on a decision of this case
in the case of Gautambhai Bababhai @ Shantibhai Patel v.
State of Gujarat and another, reported in (2012)2 GLR 1073. I
have considered the decision. There cannot be any dispute as
regards the proposition of law explained. However, the
decision is of no avail so far as the case in hand is concerned.
