Sri Abdul Wajid vs Sri A S Onkarappa on 27 December, 2010
5. It is to be noticed that the suit which was
originally filed before a regular Civil Court in
O.S.No.1346/2011 was transferred to the Court of
Small Causes in the light of the Full Bench judgment of
this Court in Abdul Wajid vs. A.S. Onkarappa (ILR 2011
KAR 229). The Court of Small Causes, on examination
of the evidence on record, has found that the plaintiffs
are the owners of the suit premises and that there was
proper termination of the tenancy and accordingly has
decreed the suit. The findings of the Court are based
on a proper consideration of the evidence on record. I
find no legal infirmity in the impugned judgment to
warrant interference under the revisional jurisdiction of
this Court under Sec.18 of the Karnataka Small Cause
-7-
CRP.No.103/2013
Courts Act,1964. No ground to admit the Revision
Petition. The Revision Petition is accordingly dismissed.
In view of dismissal of the Revision Petition, I.A.
No.1/2013 filed for interim stay also stands dismissed.
