Before considering the rival submissions and evidence on record, as also the impugned judgment and order it is necessary to note the general principles to be followed by the Appellate Court while dealing with the appeal against acquittal. The said principle have been succinctly culled out in the judgment of the Hon'ble Supreme Court in the case between Chandrappa vs. State of Karnataka reported in 2007 (4) SCC 415. The Hon'ble Supreme Court laid down the following general principles in paragraph 42 regarding powers of the Appellate court while dealing with an appeal against order of acquittal :
