On overall consideration of the entire oral and documentary evidence adduced by the parties coupled with the conduct of plaintiff in suppression of the material facts as to the filing of oral suit in OS No.677 of 1971 and dismissal of the same and confirmation in AS No.251 of 1980 is fatal to the case of the plaintiff. The plaintiff has not filed any documentary evidence in support of his claim, such as sale deed or gift deed in respect of the suit schedule property either executed by his grandmother or Page 24 of 27 AVR,J CCCA No.78 of 2001 and Tr.CCCA No.163 of 2016 mother, there is no plea of oral gift throughout his pleadings and evidence. The plaintiff did not approach the Court with clean hands and who failed to establish his title in respect of suit property. As such, in my considered opinion, the learned Judge of the trial Court failed to appreciate the oral and documentary evidence available on record in correct lines, there are infirmities in the findings recorded by the Court below and the judgment and decree liable to be set aside (Union of India and others Vs. Vasavi Cooperative Housing Society and others6).
