56. The Supreme Court in BSES Ltd. v. Tata Power Co. Ltd.,
(2004) 1 SCC 195, has laid down an important principle that
directly applies to the present case. The Court held that once a
tariff order is issued by the Regulatory Commission and published
in the Official Gazette, it becomes binding on all licensees and
consumers. The Court further held that the validity and
enforceability of tariff do not depend on the personal knowledge
or awareness of any consumer. Publication in the Gazette is treated
as sufficient notice in law.
