It is argued
that ratio of Nandhini's case has been wholly
misunderstood. Hon'ble Supreme Court has ordered that
the plaintiff is entitled for registration and opposition of
the defendant No.2 is turned down. What follows next
after registration is yet to decided. The 2 nd defendant is
having morethan 32 brands and the contention of the
plaintiff that we are into milk only is not tenable. Also
referred to the decisions relied by the plaintiff to contend
that those decisions are not applicable to the present
case.
