case (supra) that where the inquiry was conducted by the employer to
ascertain whether the probationer is fit to be confirmed the termination order
would not be punitive was reiterated.

SCR 190 Champaklal Chimanlal Shah v. Union of India wherein it was held
that a preliminary enquiry conducted by the employer to satisfy that there
was reason to dispense with the services of the probationer would not attract
the provisions of Article 311(2) of the Constitution of India.
