In a recent decision of this Court in Rajesh Kohli vs.
High Court of J & K & Anr., (2010) 12 SCC 783,
almost a similar issue cropped up for consideration,
in which this Court has held that the High Court has
a solemn duty to consider and appreciate the
service of a judicial officer before confirming him in
service and for this not only judicial performance but
also probity as to how one has conducted himself is
relevant and important. It was also held in the same
decision that upright and honest judicial officers are
needed in the district judiciary, which is the bedrock
of our judicial system.

counsel also pressed into service judgment rendered by
Hon'ble Apex Court in Shamsher Singh vs. State of Punjab
& anr., (1974)2 SCC 831 (already taken note of by learned
Single Judge), wherein Hon'ble Apex Court has held that
even an innocuously worded order terminating the service
may in the facts and circumstances of the case establish that
an enquiry into allegations of serious and grave character of
misconduct involving stigma has been made in infraction of
the provision of Article 311. In such a case the simplicity of
the form of the order will not give any sanctity.
