In 2008 4 SCC 594 [ Anathula Sudhakar Vs. P.Buchi Reddy (dead) by Lrs., and others] the Hon'ble Supreme Court had very categorically stated that when a cloud is raised over the plaintiff's title and he is not in possession, then a suit must be laid for declaration and possession, with or without consequential injunction. It had been further clarified that a cloud is said to be raised when prima facie the right of a third party is made over the property.
