18. Thus it is established that the deceased was travelling as a representa-
tive of the owner of goods in the offending vehicle. The Tribunal relied on
a decision in Ramesh Kumar Vs. National Insurance Company in
2001 ACJ 1565 (S.C.), the Apex Court held that "if a passenger is tra-
velling along with his goods on the vehicle then he cannot be termed to
be a gratutitious passenger".
