In Rajagopal Reddy vs. Padmini Chandrasekharan (1), the Supreme Court had held that the Act and Ordinance were not retrospective in operation and the Act did not apply to the pending suits which had already been filed prior to the coming into force of Sec. 4 of the Act. That being so, the learned Single Judge in the present case is not correct in holding that the appellants are not entitled for the relief as prayed for since the Act has been repealed.
