11. Now the question that arises is what is lawful
possession and whether the petitioner's possession over the
licensed premises can be considered as lawful. This issue is no
longer res integra. As early as in the year 1974, the Hon'ble
Supreme Court in the decision deported in (1974) 1 SCC
48(M.C.Chockalingam V. V.Manickavasagam) held as follows:-

12. This decision has been consistently followed. The
Hon'ble Supreme Court in the decision reported in (2006) 1
SCC 228(C.Albert Morris V. K.Chandrasekaran and others)
reiterated the position in law.
