Janki Vashdeo Bhojwani & Anr vs Indusind Bank Ltd. & Ors on 6 December, 2004
In respect to the judgment of the Apex Court in Janki Vashdeo Bhojwani
and Anr. V. Industrial Bank Ltd & Ors. (supra), the Apex Court has held in Para
18 that the Rule 2 of Order III of the CPC does not include the act of power of
attorney holder to appear as a witness on behalf of a party. The power of
attorney holder of a party can appear only as a witness in his personal capacity,
but he cannot appear as a witness on behalf of the principal.
