13.     It is pertinent to note that there is no medical expert's evidence or opinion on record to decide whether there is negligence on the part of the opposite parties as alleged in the complaint and therefore we have to decide the points considering the other available evidence on record and in this regard, we place reliance on the following decision of the Hon'ble Supreme Court in the case of V. Nizam Institute of Medical Sciences - Vs - Prasanth S. Dhananka and Others reported in 2009 - INDLAW SC 1047 wherein it is held that               "in a case involving medical negligence, once the initial burden has been discharged by the complainant, by making out of a case of negligence on the part of the hospital or the doctors concerned, the onus then shifts on to the hospital or to the attending doctors and it is for the hospital to satisfy the court that there was no lack of care or diligence".
