22. The legal position about the admissibility of a
dying declaration is settled by this Court in several
judgments. This Court in Atbir v. Govt. (NCT of Delhi),
taking into consideration the earlier judgments of this
Court in Paniben v. State of Gujarat and another
judgment of this Court in Panneerselvam v. State of
T.N. has given certain guidelines while considering a
dying declaration:
