During the course of investigation, the statement of the alleged victim was recorded under Section 180 B.N.S.S in which she made an allegation of molestation and thereafter, her statement under Section 183 B.N.S.S was recorded in which she developed a case of rape, but she denied her medical examination. Learned counsel for the applicant further submitted that the applicant is co-operating in the trial and he never misused the liberty of bail given by the learned court below.He also relied on the decision of Hon'ble Supreme Court in Sushila Agrawal & Ors. Vs. State (NCT of Delhi) & Ors. reported in MANU/SC/01002020 and Siddharth Vs. State of U.P. reported in 2021 SCC Online SC 615 and has submitted that the applicant is ready to cooperate in the proceeding and no custodial interrogation is necessary, therefore, he may be granted anticipatory bail.
