(12) There is another aspect which needs to be highlighted. An
application under Order 1 Rule 10 CPC had been filed by one Alka W/o
Lekhraj alleging that she had purchased the suit property from one Deepak
Kumar S/o Raj Kumar and Sh. Suresh Kumar S/o Som Nath by way of GPA
and agreement to sell dated 25.10.2012 and she is now possession of the
same but since she came to know that there was some court case pending in
respect of the suit property, she has therefore approached the court for
impleading herself as one of the party. Ld. Predecessor of this court on the
basis of the unregistered GPA, Will, Receipt and the fact that the applicant
had conceded that no sale deed had been executed in her favour, in the light
of the judgment in the case of "Suraj Lamp & Industries (P) Vs. State of
Haryana & Anr." decided 11 October, 2011 by the Hon'ble Supreme
Court, dismissed the said application observing that in case if the suit is
decreed then the decree passed in the case will not effect a right of the
applicant and perhaps it is this reason that the applicant has lost interest in
Smt. Roop Kumari Solanki Vs. Peter John & Ors. (Suit No. 185/15) Page No. 10 of 15
the litigation and explains her repeated nonĀappearance before this court.
FINDINGS
(13) I have considered the submissions made before me and the
evidence which has come on record and also the written memorandum of
arguments filed by the parties and the authorities relied upon by them. My
issue wise findings are as under:
