11. The constitution Bench of Hon'ble Supreme Court of India in the
decision reported in 2010 (2) Scale 467 (State of West Bengal & Ors v. The
Committee for Protection of Democratic Rights, West Bengal & Ors), has
considered the issue mainly whether the High Court in exercise of
jurisdiction under Article 226 of Constitution, can direct the CBI to
investigate the cognizable office, which is alleged to have been taken place
within the territorial jurisdiction of the State and in paragraphs 44 to 46
