opinion based on hearsay evidence and not having been
raised on any personal observation and expertize, is not free
from doubt. The said doctor did not have the dead body in his
front and also he had not conducted the postmortem himself
then how did he arrive to his opinion regarding the cause of
death? It is not clear. Moreover, the cause of death is not
certain as the doctors have not opined the same with certainty.
When the cause of death is not certain, the accused persons
can not be connected with the case on the basis of their
disclosure statements.
