an appeal under Section 39 (1) of the Indian. Arbitration Act lies against only those orders which are specifically enumerated therein and against no other, and a perusal of Section 39 (1) will show that an order under Section 41 (b) is not an appealable order. It is pointed out by the appellant that the present appeal has been preferred under Clause 10 of the Letters Patent and not under Section 39 (1). As to that, it has been laid down in Union of India v. Mohindra Supply Co.. AIR 1962 SC 256 that the Letters Patent cannot be resorted to in order to sustain an appeal against on order under the Indian Arbitration Act.
