22. The appellants have been convicted under Section 452 IPC for having
committed house trespass after having made preparation for causing hurt or
assaulting any person etc. Possibly, the appellants had committed a more
severe offence under Section 449 IPC (see Matiullah Sheikh and Others
versus State of West Bengal, (1964) 6 SCR 978). However, we refrain going
into the said aspect as the appellants already stand sentenced to imprisonment
for life for the offence under Section 302 IPC and the State has not raised the
said plea or argument. We have also not issued notice.
