In the aforementioned case the earlier decision of the Supreme Court in Union of India and Ors. v. Hindustan Development Corporation and Ors., upon which reliance has been placed by Mr. Mitra has been considered. The petitioner in view of the aforementioned decision of the Supreme Court cannot succeed in this writ petition. Nothing has been placed on record to show that any express promise was made by any officer of the respondent No. 1 to the petitioner.
