7. Learned counsel for the opposite party submitted that subject matter in the case referred to above by the petitioner is completely different from the present case. In that case, Supreme Court has clearly observed that proceeding under Section 145, Cr.P.C. should not be dropped on the ground that civil suit is pending where the title is not a question and only dispossession is involved in that suit. But in the present case, both the title and possession of the disputed land have been challenged.
