Girmi Vs. Gangabisan Ramgopal AIR 1940 Bom. 369, where an
auction held by the Collector of Ahmednagar in respect of right
of Government to collect toll on two public roads under the Tolls
on Roads and Bridges Act, 1875, the plaintiff and defendants
entered into a partnership, shortly before the auction, to acquire
the lease from the Government, agreeing not to bid against each
other and the lease of these tolls was secured by the plaintiff and
defendant no.1 in respect of one of these roads and by the
defendant nos.1 and 2 in respect of other, while answering the
question whether the agreement between the parties not to bid
against one another was illegal, it was held that the agreement was
not illegal as not opposed to public policy.
