Wassoodew J. of the Bombay High Court delivering judgment in that case expressly observes that by reason of Section 73(3), Civil P. C., stating that nothing in that section affects any right of the Government, that provision of the Civil Procedure Code by necessary implication should be construed to contain express reservation of the right to claim precedence for a Crown debt and the Court in whose hands the assets are lying is bound as a Court of equity and justice, to respect the priority of Government if it is brought to its notice.
