In my view improper rejection of a nomination paper and an improper acceptance of a nomination paper belong to the same category of act which can come under the doctrine of ejusdem generis & although they represent 2 contrary cases they belong to the same genus of notions. 'Ejusdem generis' rule in any event should be applied with caution so as not to unnecessarily restrict its meaning. A somewhat similar point arose for determination in the case -- 'A. B. Mitchell v. J. C. Dutt', 32 Cal WN 264, where the dispute was with regard to a nomination which had become void for failure to make the requisite nomination deposit under Section 27(3) of the Act and that void nomination was put forward as a ground for disputing the validity of election.
