1 - 8 of 8 (0.22 seconds)Ramesh Himmatlal Shah vs Harsukh Jadhavji Joshi on 25 April, 1975
8. We find that the Revisional Authority in the
impugned order dated 13/10/2003 has relied upon the decision
of the Apex Court in case of Ramesh Himmatlal Shah Vs.
Harsukh Jadhavji Joshi reported in AIR 1975 Supreme Court
1470 to hold that there is no provision under the said Act to
obtain prior permission of Society before acquiring any interest
in the plot of Society.

Ajay Hasia Etc vs Khalid Mujib Sehravardi & Ors. Etc on 13 November, 1980
The Apex Court has further held that Co-
operative Society is not State unless the tests indicated in Ajay
Hasia Vs. Khalid Mujib Sehravardi (1981) 1 SCC 722 case are
satisfied. It is further observed that it is not possible to argue
that a person has a fundamental right to become a member of a
voluntary association or of a cooperative society governed by its
own bye-laws. In this context, it would be profitable to
reproduce paragraph 34 which reads as under :
The Maharashtra Co-Operative Societies Act, 1960
The Meghalaya Co-operative Societies Act
Section 23 in The Maharashtra Co-Operative Societies Act, 1960 [Entire Act]
