In (1997) 2 SCC 267 [T.N.Godavarman Thirumulkpad v. Union of india and others], the Supreme Court had categorically directed the Forest department throughout the country to scrupulously follow the provisions of Forest (Conservation) Act. In the said Judgment it was also specifically made clear that "mining activity is non-forestry activities and that should be ceased forthwith". As per the direction of the Supreme Court felling of trees in all forests is to remain suspended except in accordance with the working plans of the State Governments, as approved by the Central Government. In so far as, in State of Tamil Nadu, there will be a complete ban on felling of trees in all forest areas except in accordance with the plans of State Government.
