Without adverting to the principles culled out by the learned Magistrate for dealing with the application under Section 321 CrPC, I straightaway refer to the judgment of the Supreme Court reported as Abdul Karim and others Vs. State of Karnataka and others (2000) 8 SCC 710 wherein the broad principles governing the refusal or grant of the application under Section 321 CrPC were reiterated as laid down in Sheonandan Paswan v. State of Bihar . These are in short as under:-
