Learned counsel has sought to argue that the decision of
the Supreme Court in Shamim Ara's case (Supra) has no application
in the facts of the present matter as the said case was filed under
Section 125 of the Code of Criminal Procedure, whereas, in the
present matter, the appellant had filed a divorce case.
