Accordingly, the present criminal misc. application succeeds and is allowed. The impugned Summoning Order dated 5.12.2022 passed by First Additional Civil Judge (S.D.)/Additional Chief Judicial Magistrate, Amroha in Complaint Case No. 2771 of 2022 (Smt. Kusum Devi Vs. Manoj and others) under Sections 323, 354B, 427, 504 I.P.C., Police Station Amroha Dehat, District Amroha, is set aside. The First Additional Civil Judge (S.D.)/Additional Chief Judicial Magistrate, Amroha shall pass a fresh order in the light of the observations made herein above.
