9. The learned counsel for the petitioner also relied upon
the decision of this Court in K.K.Venugopalan v. State of
Kerala (2008(1) KHC 535) to contend that Section 47 of the
Act enables an employee to claim that he be accommodated in a
post with the same pay scale and service benefits. An identical
question as raised in this Writ Petition was considered therein.
