19. After taking note of the ruling of the Constitution Bench of the
Supreme Court in Matajog Dubey Vs. H.C. Bhari, AIR 1956 SC 44 on
the subject of sanction under Section 197 Cr. PC against a public
servant accused of an offence purporting to act in the "discharge of
his official duty", as well as of other cases namely Centre for Public
Interest Litigation vs. Union of India, (2005) 8 SCC 202; Kalicharan
Mahapatra vs. State of Orissa, (1998) 6 SCC 411 and Lalu Prasad vs.
State of Bihar, (2007) 1 SCC 49, this court in State Vs. Mukesh Kumar
