37.PW-7 Sh. Madan Lal who was a truck driver and PW-8 Sh.
Prakash Chand, Retd. Deputy Secretary have not supported
the prosecution version at all and were declared hostile by
the Ld. APP for the State. Though they were thoroughly
cross-examined by Ld. APP for the State, but nothing
beneficial to the prosecution has emerged out of the same
and, therefore, their statements are not of any help to the
prosecution. Though, it is a settled law that evidence of a
hostile witness cannot be discarded completely as laid
down by the Hon'ble Apex Court in Rohtash Kumar v.
State of Haryana (2013) 14 SCC 434, however, in the
present case, PW-7 and PW-8 have not stated anything
incriminating against the accused persons and thus, their
statement do not help the prosecution.
