In support of his submission the learned counsel relied upon the recent judgment of the Hon'ble Supreme Court in the case of Mohan Lal Vs. The State of Punjab and also relied upon the judgment in the case of A.Sivaprakash Vs. State of Kerala reported in (2016) 3 MLJ (Crl) 97 (SC) wherein the Hon'ble Supreme Court has held that when there is no evidence to hold that the accused had pecuniary advantage by his misconduct, he cannot be convicted under Section 13(1)(d) (ii) and (iii).
