State v. Nawab 13  As   observed   in   Mohd.   Javed's   case   (Supra), evidence   of   police   officials   cannot   be   rejected   per   se merely   because   independent   public   witnesses   are   not associated and  it puts the court on guard to scrutinize the   statement   of   police   officials   with   great   care   and caution.     Herein,   court   has   carefully   scrutinized   the statement   of   material   witnesses   examined   by   the prosecution.

State vs Nawab Ali & Ors on 6 July, 2010

State v. Nawab A private wagon is said to have been used by SI Sanjay Neolia on the given date in reaching the spot. Ld. Defence Counsel submitted that there is nothing on record to suggest as to why official vehicle was not used in reaching the spot.   It also remains unexplained if SI Sanjay Neolia claimed any travelling expenses by use of his private car.   The contention is that all this creates doubt   if   any   such   party   headed   by   SI   Sanjay   Neolia reached   the   spot   or   apprehended   the   accused.
