79. It cannot be thus said that the claim dated 26.06.2014 of the
respondent/claimant pursuant to Ex.C.68 Notice dated 17.03.2014 before
the Arbitral Tribunal was time barred in the light of the decision of the
Hon’ble Supreme Court in Bharat Sanchar Nigam Limited and
Another v. Nortel Networks (India) (P) Ltd, (2021) 5 SCC 738 as the
said decision was rendered in the peculiar facts of the case therein by the
Hon’ble Supreme Court.
