According to counsel for the petitioners, pre-arrest bail
application has been rejected by the Additional Sessions Judge, Kurukshetra
on the ground that Section 18 of Scheduled Castes and Scheduled Tribes
(Prevention of Atrocities) Act, 1989 would operate as a bar. He further
submitted that in the case of co-accused in the same complaint, this Court in
CRM-M No.17072 of 2015 titled "Girdhari Lal and another Vs. Devender
Kumar and another" has granted liberty to the petitioners therein for
seeking regular bail after surrendering before the Court and their arrest has
been stayed till the decision thereof.
