7.1 This Court in case of Govardhankumar
Thakoredas Asrani Vs. State of Gujarat (supra), in para
(48), while referring to the case of C. Muniappan & Ors.
vs. State of Tamil Nadu (supra), has observed about the
ratio laid down in various judgments in connection to the
provision of section 195 Cr.P.C., which read as under:

"9. As rightly pointed out by the learned
counsel for the parties on the strength of
law laid down by this Court in Daulat Ram
v. State of Punjab that in order to prosecute

an accused for an offence punishable under
Section 182 IPC, it is mandatory to follow
the procedure prescribed under Section
