Surya Dev Rai vs Ram Chander Rai & Ors on 7 August, 2003

In view of the aforesaid law relied upon by learned Counsel for the respondent-landlord and also in view of the law laid down by the Apex Court in the case reported in (2003) 6 SCC, 675 : 2003 (2) ARC 385, Surya Dev Rai v. Ram Chander Rai and Ors., I do not find this to be a fit case for interference by this Court in exercise of power under Article 226 of the Constitution of India. This writ petition therefore, has no merits and is accordingly dismissed. The interim order, if any, stands vacated. However, the parties shall bear their own costs.
