31. Perusal of judgment of LIC of India & Anr vs Ram Pal
Singh Bisen (2010)4 SCC 491 and more specifically in
paragraph 25 of cited judgment it was noted that, oral evidence

was not brought by defendant/appellant and no defence was put
to respondent during the cross examination whereas in the
present suit Ex DW-1/3 is in complete knowledge of Plaintiff
Moreover in paragraph 28 of the cited judgment it was noted
that complainant of the case was not examined and there are
other circumstances of the case which makes it distinguishable
in reference to the present case. It's a settled law that judgment
cannot be read in isolation with facts narrated therein.
