In D. L. F. Housing and Construction Co. (P) Ltd. v. Sarup Singh AIR 1971 SC 2324, their Lordships of the Supreme Court set aside an order passed by the High Court under Section 115, CPC, by which the High Court had set aside the orders passed by the courts below refusing to grant a temporary injunction on this very ground, namely, that it was not permissible for the High Court to interfere with the orders passed by. the lower courts merely because the High Court differed from the courts below on the question whether an injunction should be granted or not.
