I.C. Golak Nath And Ors. vs State Of Punjab And Anr. on 27 February, 1967

The nature of power under Article 141 of the Constitution as is referred under the Golak Nath's case (supra) was in such circumstance under which an issue that arose for consideration was violative of the fundamental right in the context of legislation made by the States for agrarian revolution. To protect such legislations which were made between 1950 and 1967, the Apex Court resorted to rely upon American Doctrine of Prospective Overruling to save such enactments.
